What the claims cover, in plain language
Claim 1 - a drinking bottle with a fixed mouth, a movable mouth, a threaded collar, a flexible catch, outer and inner threads, a rubber seal ring, a notch, the bottle and a cap. Fixed mouth, collar and bottle are one piece; the movable mouth sits between the fixed mouth and the collar and is lower than the collar. The catch on top of the movable mouth bends to snap into the notch at the top of the collar; screwing on the cap presses the catch against the collar while the cap’s seal ring presses on the fixed mouth. The catch can be freed to pull the movable mouth up. Both mouths are truncated cones, sized so that the friction between them holds the movable mouth when pulled up.
Claim 2 - the flexible catch is soft, easily deformed silicone.
This is a simplified reading for orientation only. The legal scope is defined by the exact claim wording in the official Chinese document.
What this means for US production
This patent was filed only in China and has lapsed, so it no longer restricts anyone in China either. It has no US or other foreign counterpart.
Two points to settle early:
- Other patents may exist. Water bottle lids, spouts and dual-opening caps are among the most patented consumer products in the US, so a freedom-to-operate (FTO) review of the nested mouths and catch is advisable before tooling.
- Leak-tightness. The joint between the two cones must stay dry when the bottle is tipped; the cone taper and seal are proven by leak tests.
Customization and manufacturing
What can be customized
| Area | Options |
|---|---|
| Bottle | Tritan, PP or PET; 500-1000 ml; clear or tinted |
| Mouths | Cone height and taper, color-coded outer mouth |
| Catch | Silicone color, tab shape for easy release |
| Cap | Screw cap, carry loop, flip cap over the inner mouth |
| Branding | Printed or embossed logos, measurement marks |
| Packaging | Retail box, multi-packs, promotional bulk |
Things to plan for (US market)
- FDA food contact - bottle plastics meet 21 CFR 177 (for example 21 CFR 177.1520 for PP) and the silicone catch meets 21 CFR 177.2600.
- BPA and claims - “BPA-free” and similar claims must be truthful under FTC rules.
- California Prop 65 - plastics, colorants and inks are screened.
- CPSIA - versions marketed to children 12 and under need lead and phthalate testing and a Children’s Product Certificate.
- Dishwasher claims - top-rack dishwasher safety is tested before it is printed on the pack.
How a project runs
- Inquiry - bottle size, material, branding and quantity.
- Design - cone tapers, collar notch, catch and cap seal.
- Prototype - samples for pull force, hold and leak tests.
- Pilot run - drop tests, dishwasher cycles, food-contact testing.
- Production - bottle blow or injection molding, mouth and cap molding, silicone overmold, assembly.
Quantities & timeline
The bottle needs an injection-blow or stretch-blow mold, the movable mouth and cap need injection molds, and the silicone catch is overmolded or fitted. Tuning the friction fit and leak-tightness takes most of the development time. Send us your bottle size, material, branding, quantity and target price and we will reply with options.
