What the claims cover, in plain language

Claim 1 - a vocal breath exerciser with a tube, a blowing nozzle at one end and an end cap at the other. The tube has a ring boss onto which the cap screws, and a through-hole inside the boss. A rubber seal between tube and cap blocks the hole, pressed by a spring fixed to the inside of the cap; the cap has vent holes outside the spring.

Claim 2 - a ring step on the tube that the nozzle slides onto, with a sealing ring. Claim 3 - matching guide surfaces on the step and inside the nozzle for easy fitting. Claim 4 - a ring-shaped groove on the nozzle for the lips.

This is a simplified reading for orientation only. The legal scope is defined by the exact claim wording in the official Chinese document.

What this means for US production

This patent was filed only in China, and it lapsed for non-payment of annual fees (recorded in 2020). It no longer restricts anyone - in China or elsewhere.

Before production, keep in mind:

  • Other patents may exist. Breathing trainers - including respiratory muscle trainers sold for health and sport - are covered by US patents. Use your own styling and have a freedom-to-operate (FTO) search done by a US patent attorney before volume production.

Things to plan for (US market)

  • Positioning decides the rules - as a voice-practice or music accessory it is a consumer product. If it is marketed to treat or improve a medical breathing condition, it may be a medical device: the brand owner must confirm the FDA classification, register and list it, and support any health claims; a factory making a medical device for the US must also register with the FDA.
  • Mouth contact - use materials suitable for mouth contact and give cleaning instructions.
  • Children - a version for children 12 and under needs CPSIA testing; check small-part rules for the mouthpiece.

How a project runs

  1. Inquiry - positioning, resistance levels and quantity.
  2. Design - tube, valve, spring sets and mouthpiece.
  3. Prototype - samples for opening-pressure and user tests.
  4. Pilot run - small batch to check molding and spring consistency.
  5. Production - volume production, packaging and shipping.

Quantities & timeline

Tube, cap and mouthpiece are small injection-molded parts; the seal and spring are standard components. Send us your positioning, resistance levels, quantity and target price and we will reply with options.
