What the claims cover, in plain language

Claim 1 - a pressing writing instrument comprising a pen body, a refill inside it, a spring on the refill, and a push-type pen clip that slides on the pen body to move the refill. The clip has an elastic arm with a guiding projection. The pen body has a mounting hole containing a mounting portion that guides the projection. The inner surface of the mounting portion has a first locating guide, a second locating guide, an unlock protrusion and a spacer bar. The first locating guide has an inclined first guide surface at the top and a V-shaped card slot at the bottom, with a second guide surface and a vertical third guide surface. The second locating guide has a first convex slope and an inclined surface that connect to the first guide surface and the card slot. The unlock protrusion sits inside the card slot and has a second convex slope and an unlock guide surface, separated from the inclined surface by the spacer bar.

Claim 2 - the first guide surface, second guide surface, third guide surface and unlock guide surface are perpendicular to the inner surface of the mounting portion. Claim 3 - the first convex slope, inclined surface and second convex slope are angled relative to the inner surface. Claims 4-6 - the mounting portion fits into the mounting hole, secured by upper and lower clamping portions forming a channel for the guiding projection, with an anti-slip protrusion between the upper clamps. Claim 7 - the guiding projection has a decline guide surface engaging the first guide surface and a limit guide surface engaging the second guide surface. Claims 8-10 - a swivel device is mounted on the mounting portion. The clip has rack gears that mesh with gears on connecting shafts of swivel plates, causing the plates to rotate when the clip is pressed.

This is a simplified reading for orientation only. The legal scope is defined by the exact claim wording in the official Chinese document.

What this means for US production

This patent was filed only in China and its utility model status is Withdrawn - After Issue (actively abandoned on 2023-11-03). It has no US or other foreign counterpart.

Two points to settle early:

  • Other patents may exist. Retractable pen click mechanisms, especially those involving cam followers, elastic arms and rotating clips, are heavily patented by major global stationery brands. A freedom-to-operate (FTO) review of the specific guiding projection path, V-slot locking and rack-driven swivel features is needed before tooling.
  • Mechanism integration. The mounting portion must fit precisely into the barrel. Molds require tight tolerances so the guiding projection does not bind or slip past the unlock protrusion prematurely.

Customization and manufacturing

What can be customized

AreaOptions
Barrel materialABS, AS, PC, or recycled plastics; soft-touch TPE overmold grips
Refill typeStandard D1 ballpoint, gel roller, or hybrid ink cartridges
Clip stylingShape, length and thickness of the pressing part; logo engraving or printing
Swivel featureInclude or omit the rack-and-gear swivel plates; customize the plate artwork
Colors and finishSolid colors, transparent barrels, metallic plating, or matte coatings
PackagingBulk polybags, blister cards, or custom retail boxes

Things to plan for (US market)

  • ASTM D4236 - the Labeling of Hazardous Art Materials Act requires chronic health hazard labeling if the pen is marketed for art use; standard office pens generally need ink toxicity evaluation.
  • LHAMA (Consumer Product Safety Improvement Act) - if the pen is intended for children under 12, it must comply with CPSIA testing requirements, including lead and phthalate limits in the plastic barrel, grip and ink.
  • California Proposition 65 - plasticizers, pigments and plated finishes used on the clip or barrel must be screened for listed chemicals.
  • Ink safety - inks should conform to EN 71-3 or ASTM F963 heavy element migration limits if sold in school supply channels.

How a project runs

  1. Inquiry - target audience, refill preference, material choices, whether the swivel feature is needed, and quantity.
  2. Design - CAD modeling of the barrel, mounting portion, clip and elastic arm to ensure the guiding projection traces the V-slot accurately.
  3. Prototype - 3D printed or soft-tooled samples to test the click feel, locking security and spring return force.
  4. Pilot run - injection mold fabrication, assembly line setup, and batch testing for click-cycle durability and drop resistance.
  5. Production - mass injection molding, pad printing or heat transfer for branding, refill insertion, final assembly and quality inspection.

Quantities & timeline

Manufacturing this pen requires precision injection molds for the barrel, the mounting portion insert, and the push-type clip with its elastic arm. If the swivel device is included, additional molds for the gears and swivel plates are necessary. Cycle testing to verify the V-slot locking over thousands of presses takes significant development time. Send us your material preferences, refill type, feature requirements, quantity and target price and we will reply with options.
