What the claims cover, in plain language

Claim 1 - a pull-action pen with an outer barrel, a return spring, a refill, an adjusting piece, a rotating follower, a positioning piece and a rotating fastener. The positioning piece has a cam track; one end of the follower is mounted on the adjusting piece and its other end moves in the track. One end of the fastener is mounted on the adjusting piece and the other presses against the follower. The track has a tip-out boss and a retract switching wall.

Claim 2 - the follower has two stable positions: retracted (held by the spring) and tip-out (held by the boss against the spring). Claim 3 - the track also has a long switching wall that steers the follower. Claims 4-10 - further features described in the patent, such as limit and helper walls, buffer grooves, the fastener’s clamping and pressure parts, and the detachable clip and front section.

This is a simplified reading for orientation only. The legal scope is defined by the exact claim wording in the official Chinese document.

What this means for US production

This patent was filed only in China. It is still in force in China, so making or selling this design in China would need the owner’s permission while it lasts (at most until 2032-06-11). It has no US or other foreign counterpart and does not restrict the design outside China.

Two points to settle early:

  • Other patents may exist. Retractable pen mechanisms are an old and dense patent field, and established pen makers continue to file on new actuation styles; a freedom-to-operate (FTO) review of the final cam and actuation design by a US patent attorney should come before tooling.
  • Tolerances decide the feel. The friction that resists gravity must not make the slide stiff; the balance is set by the fastener’s pressure and molding tolerances and proven on tooled samples.

Customization and manufacturing

What can be customized

AreaOptions
BarrelABS or PC plastic, aluminum or brass; soft-touch, lacquer or anodized finishes
RefillBallpoint, gel or hybrid ink; standard refill formats; line widths
ClipMetal or plastic, removable, cover-style clip
ActionSlide force and travel set by spring and track design
DecorationPad print, laser engraving, full-wrap printing
PackagingBulk promo packs, retail cards, gift boxes

Things to plan for (US market)

  • ASTM D4236 / LHAMA - if marketed as an art or drawing pen, the ink needs toxicological review and the conforming label.
  • CPSIA - pens marketed to children 12 and under need lead and surface-coating testing, a Children’s Product Certificate and tracking labels.
  • ISO 11540 vented caps - if the clip is designed to work as a cap, a ventilated cap design is the accepted way to reduce the choking risk.
  • California Prop 65 - check inks, plastics and metal plating.

How a project runs

  1. Inquiry - barrel material, refill type, decoration and quantity.
  2. Design - cam module adapted to your barrel diameter and length.
  3. Prototype - samples tested for slide force, latch stability when shaken and inverted, and life cycles.
  4. Pilot run - small batch for assembly-line timing, ink and packaging checks.
  5. Production - volume production, decoration, packaging and shipping.

Quantities & timeline

The positioning piece, follower, fastener and adjusting piece need small precision injection molds, barrels need injection molds or metal tube machining and finishing, and springs are made to the set force; the pre-assembled latch module allows automated assembly. Most development time goes into the track and fastener pressure. Send us your barrel material, refill type, quantity and target price and we will reply with options.
